Workplace Injuries


Who is eligible?

As an employee in Queensland your employer is required to provide Worker’s Compensation insurance to protect you in the workplace. Even if you are employed by your own company you may be eligible. If you are injured in the workplace the injury could significantly reduce your ability to earn income in the future.


How do I claim?

In Queensland there are two types of claims available for workplace injuries:


1. Common Law Claims

If the injuries you sustained in your workplace can be proven to be as a result of the negligence of your employer you may be eligible for compensation for loss of wages, permanent impairment, medical and hospital expenses and any necessary rehabilitation required. Injuries are not limited to physical injuries suffered but can also include stress related injuries. Common Law claims can also be made if death has resulted from the workplace accident.


2. Statutory Claims

If you are injured at work we can simply lodge a claim form with the insurer. In Queensland the insurer is WorkCover but in some instances the employer may “self insure”. Under this type of claim the legislation provides that you may be eligible to be paid a lump sum in addition to expenses such as loss of wages and medical expenses.

How much will it cost?

At your initial free consultation your solicitor will discuss the types of payment structures available. It is important that you discuss with your solicitor the different payment structures available eg. “No Win No Fee” or “Deferred Fee.”


How long does a Common Law claim take?

The length of time taken to finalise a common law claim will be dependent on your injuries and the time it takes for those injuries to stabilise. It is important that the compensation received will be an amount that will cover you for your future.
