Making an Enduring Power of Attorney

What is a Power of Attorney?

A Power of Attorney is a legal document which allows another person to act on your behalf to handle your affairs. An Enduring Power of Attorney allows your appointed attorney to deal with all or any part of your financial and personal matters, and allows them to continue should you lose capacity.

It is a good idea to have a power of attorney if you: go overseas, take an extended holiday, suffer poor health or you simply reach a greater age where you need more assistance. A power of attorney operates during your life.


Appointing your attorney

Your attorney must be over 18 years of age, and it is important that your attorney be someone that you trust and someone who is capable of looking after your affairs.


Making an enduring power of attorney

When preparing your enduring power of attorney it is a good idea that you speak with your solicitor about the following:

  • Your choice of attorney and number of attorneys;
  • The scope of power given to your attorney/s;
  • Any additional conditions or requirements you may wish to include;
  • When you would like the enduring power of attorney to commence; and
  • For your enduring power of attorney to be valid it must follow the strict witnessing requirements and be prepared in the required form.
