Advice You Can Understand

Motor Vehicle Accidents

Who is eligible?

In Queensland it is compulsory for all registered vehicles to carry third party insurance (CTP). This insurance covers the driver if they have been involved in an accident causing injury to another person. Even if the driver is only partially to blame for the accident you may still bring a claim for compensation.

If you have been injured by a motor vehicle, motor bike, boat, trailer or another registered vehicle you may be entitled to compensation through CTP.

Even if the vehicle is unregistered or unidentifiable you may still have a claim through the Nominal Defendant.

When should I claim?

Strict time limited apply to the bringing of claims. If is therefore important that you speak to one of our solicitors as soon as possible. It is also important to speak to one of our solicitors before signing any documentation from the driver or the driver’s insurance company as this may affect your claim for compensation.

What can I be compensated for?

If you have been injured and the injury is established as being wholly or partially the fault of the driver of the vehicle you may be compensated for future loss of wages, present and future medical expenses and damages for pain and suffering.

How long will the claim take?

The length of the claim will depend on your injuries and the time it takes for those injuries to stabilise.

How much will it cost to make a claim?

At your initial free consultation your solicitor will discuss the types of payment structures available. It is important that you discuss with your solicitor the different payment structures available eg. “No Win No Fee” or “Deferred Fee.”
