It is human nature to leave everything until the last possible moment and often until it is simply too late. We have to ask why people work hard to establish a good quality of life, fight hard to maintain this way of life but then let it all fall apart by not taking the simple steps of preparing and maintaining a will. Most wills are fairly simple and take under an hour to complete. A will allows you to leave your assets to the people you want to have them. A properly executed will saves you money. Arguments over who shall have what can end up in Court, so instead of your assets going to those you care about, they get consumed by legal costs. Without a proper will Estates are administered by the Public Trustee.
This is also costly as the Public Trustee will take a substantial percentage
of the Estate for administration fees. It makes sense to prepare - execute
a Will. The Enduring Power of Attorney is the next most important document. This allows a nominated person to act on your behalf when you are unable to do so for whatever reason, such as incapacity or you are away from home. This power can be made conditional. It can be given in relation to financial, land, health care or general dealings. It can commence immediately, on a set date, or on a certain event such as injury, and means that things do not stop because you cannot be there.
